The Lung Association gave the U.S. Food and Drug Administration a B for its regulation of tobacco products, and the federal government a D for $1.01 tax rate on a pack of 20 cigarettes. The federal government received a C for cessation coverage. The Patient Protection and Affordable Care Act requires the majority of private health plans to provide tobacco-cessation treatments.
However, Medicaid,[link widoczny dla zalogowanych], a health care program for low-income people, provides only limited coverage. Dr. Irwin Berlin, chairman of the American Lung Association in New York’s board, said there are too many barriers to treatment in the state. “We need better coverage for cessation so everyone can access it,” he said. More coverage is provided for state employees. There is no mandate for private insurers to cover medications and counseling.
The Larkspur City Council on Wednesday worked on changes to its smoking ordinance,[link widoczny dla zalogowanych], which would bar smoking in condominium and apartment buildings — except in designated areas — and declare lighting up a public nuisance, Mayor Larry Chu said. The proposed changes will likely come back to the council for a vote in February. “I don’t look at the grade and say ‘Oh, well,[link widoczny dla zalogowanych], Larkspur has to improve it,’” Chu said. “I’m looking at it and saying,[link widoczny dla zalogowanych], ‘Do we have adequate protections from second-hand and tertiary smoke?’

Supervisor Charles McGlashan said other issues have pushed smoking laws to the back burner. “We are so busy with the bag ordinance, Marin Clean Energy and other things we don’t have the bandwidth to deal with it right now,” he said. “But it is on our list.”

The legislation almost caused the cancellation of the 2004 Canadian Grand Prix in Montreal due to the heavy involvement of the cigarette industry in F1 at the time. The race was reinstated after a deal saw the race organizers pay $29-million to the then-five tobacco sponsored teams for the loss of revenue due to the ban on cigarette sponsorship and advertising in Montreal.
